Welcome to Style Crumbs! These Terms and Conditions (“Terms,” “Agreement”) govern your access to and use of the Style Crumbs website (the “Site”) and the purchase and use of digital patterns (“Digital Products” or “Patterns”) available through the Site.

By accessing or using the Site, purchasing any Digital Product, or downloading any content, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or purchase any Digital Products.

1. Definitions

  • “Site,” “We,” “Us,” “Our”: Refers to Style Crumbs.
  • “You,” “User,” “Customer”: Refers to any person who accesses or uses the Site or purchases Digital Products.
  • “Digital Products,” “Patterns”: Refers to the digital sewing patterns, knitting patterns, embroidery patterns, or other digital files available for purchase and download on the Site.
  • “Finished Products”: Refers to physical items handmade by you using a Digital Product (e.g., a garment sewn from a pattern, a knitted item, an embroidered piece).

2. Digital Products – Purchase and Delivery

2.1. Product Description:

We make every effort to describe and display our Digital Products accurately on the Site. However, colors and details may vary slightly depending on your device’s display and printer settings.

2.2. Instant Download:

All Digital Products are provided as instant digital downloads. No physical product will be shipped to you. Upon successful payment, you will receive a link to download your purchased Pattern(s). This link will typically be available on the order confirmation page and sent to your email address.

2.3. Technical Requirements:

To access and use our Digital Products, you will need compatible software (e.g., a PDF reader) and hardware (e.g., a computer or tablet) capable of opening and printing digital files. PDF instructions are generally not included with the pattern downloads unless explicitly stated on the product page. Increasing the file size may reduce its quality. It is your responsibility to ensure you have the necessary technical capabilities before purchasing.

3. Pricing and Payment

3.1. Pricing:

All prices for Digital Products are listed in Canadian Dollars (CAD) unless otherwise stated. Prices are subject to change without prior notice.

3.2. Payment:

Payments are processed securely through third-party payment processors (e.g., PayPal, Stripe, Google Pay, Apple Pay). We do not store your full payment card details. By completing a purchase, you agree to their respective terms and privacy policies.

4. Refunds and Returns for Digital Products

4.1. All Sales Final:

Due to the immediate, irreversible, and intangible nature of digital downloads, all sales of Digital Products are final and non-refundable. Once a digital file has been purchased and made available for download, it cannot be “returned” or cancelled.

4.2. Exceptions (Limited Circumstances):

Duplicate Purchase:

If you accidentally purchase the exact same Digital Product twice, please contact us within 7 days of the duplicate purchase, and we may issue a refund for the duplicate transaction.

Technical Issues Preventing Access:

In the rare event of a verified technical issue on our part that genuinely prevents you from downloading or accessing a purchased Digital Product (and we are unable to resolve it within a reasonable timeframe), a refund may be considered at our sole discretion. You must provide clear evidence of the issue.

4.3. How to Request a Review for Exception:

All refund requests must be submitted to info@stylecrumbs.com within the specified timeframe, including your order number and a detailed explanation of the issue. We reserve the right to deny any refund request that does not meet the criteria outlined in this section.

5. Copyright and Licensing

5.1. Ownership:

All Digital Products, content on the Site (including text, graphics, logos, images, software, and the compilation thereof), and underlying intellectual property are the exclusive property of Style Crumbs and are protected by Canadian and international copyright laws. All rights not expressly granted to you are reserved by Style Crumbs. © Style Crumbs. All rights reserved.

5.2. License Granted – Non-Transferable:

When you purchase a Digital Product, you are granted a non-exclusive, non-transferable, revocable license to use the Digital Product under the terms specified herein. This license is granted solely to the individual or entity who completed the purchase and cannot be shared, assigned, or sublicensed to any other person or entity.

5.3. Permitted Use (Standard Commercial License):

For each Digital Product purchased, you are granted a license to create up to 1,000 (one thousand) physical Finished Products for sale using the purchased Pattern.

This includes:

  • Downloading and printing the Pattern for your crafting projects.
  • Creating physical Finished Products yourself through handmade means (e.g., sewing, knitting, embroidery for items like garments, bags, accessories).
  • Utilizing Print-on-Demand (POD) services (e.g., Printful) solely for the purpose of manufacturing physical Finished Products for sale within the 1,000 unit limit. This means the POD service acts as a production partner for your physical products, and you are solely responsible for selling and marketing these physical items.
  • Selling the physical Finished Products made from the Pattern, whether handmade by you or manufactured via a POD service under the terms above.
  • Credit “Pattern by Style Crumbs” when showcasing or selling Finished Products online is appreciated but not strictly required unless specifically stated on the individual product page.

5.4. Prohibited Uses:

You may NOT (and expressly agree not to):

  • No Digital Resale or Sharing: Distribute, share, sell, sublicense, rent, lend, or give away the digital Pattern file (PDF, etc.) to anyone else, whether for free or for payment. Digital resale or redistribution of the digital file is strictly prohibited.
  • No Mass Production (Beyond Limit): Produce more than 1,000 physical Finished Products for sale using a single Pattern purchase. This license is for small-batch, handmade, or limited-scale manufacturing only and does not permit industrial mass production.
  • No Digital Redistribution/Modification: Deconstruct, modify, adapt, translate, reverse-engineer, or repackage this artwork as clipart, any other digital format, or create derivative digital works for sale or free distribution.
  • No Upload to Design Licensing or Marketplace Platforms as Your Own Design: You cannot upload the Pattern file (or any part of it) to design licensing websites (e.g., Spoonflower.com, Shutterstock) or any print-on-demand marketplaces (e.g., Redbubble, Society6, Zazzle, Teepublic) where the primary purpose is to sell or license the digital design itself, or where the platform sells products featuring your design without your direct control over units sold or authorship. This includes uploading the pattern file to claim it as your original work or for others to purchase or license the digital pattern from such platforms.
  • No Claim of Authorship: Claim the Pattern design or any part of the Digital Product as your own.
  • No Commercial Use Beyond Scope: Use the Digital Product for any commercial purpose not explicitly permitted by this license.

6. User Conduct

You agree not to use the Site or Digital Products for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. You agree not to upload or transmit any computer viruses, malware, or any material that is unlawful, harmful, defamatory, obscene, or infringing on the rights of others.

7. Third-Party Links

Our Site may contain links to third-party websites or services that are not owned or controlled by Style Crumbs. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Style Crumbs shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

8. Disclaimers and Limitation of Liability

8.1. “As Is” Basis:

The Site and all Digital Products are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2. Accuracy:

While we strive for accuracy, we do not warrant that the descriptions of Digital Products or other content on the Site are accurate, complete, reliable, current, or error-free.

8.3. Limitation of Liability:

To the fullest extent permitted by applicable law, Style Crumbs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your access to or use of, or inability to access or use, the Site or any Digital Products.

9. Indemnification

You agree to indemnify, defend, and hold harmless Style Crumbs, its owner(s), employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Site or Digital Products, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.

10. Force Majeure

Style Crumbs shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Style Crumbs’ reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation, internet service provider failure or delay, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

11. Termination

We reserve the right to terminate or suspend your access to all or part of the Site and your license to use Digital Products immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Digital Products granted under these Terms will immediately cease.

12. Entire Agreement & Severability

These Terms, together with any operating rules or policies posted by us on this Site or in respect to the Digital Products, constitute the entire agreement and understanding between you and Style Crumbs. If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Ontario for the resolution of any disputes.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site or purchase Digital Products after those revisions become effective, you agree to be bound by the revised terms.
